Release and Waiver of Liability

VOLUNTEER RELEASE AND WAIVER OF LIABILITY

IMPORTANT: THIS IS A LEGAL COMMITMENT; READ IN FULL AND UNDERSTAND BEFORE AGREEING TO, AND ACCEPTING, THE TERMS HEREUNDER
In order to volunteer in the Vancouver Halloween Parade & Expo, you must accept and agree to the terms contained herein, which is a Release and Waiver of Liability ("Release") in favour of the Vancouver International Halloween Festival Society, its directors and employees, the City of Vancouver, the Province of British Columbia, parade volunteers, all sponsors, all contractors, and each and every affiliate, agent and representative of the foregoing (collectively, all such parties are the "Released Parties") and by doing so, in consideration of you being accepted to volunteer in the Vancouver Halloween Parade & Expo and for other good and valuable consideration (the sufficiency of which is hereby acknowledged), you agree as follows:

ASSUMPTION OF RISK: 

I recognize and understand the risks associated with volunteering in the Vancouver Halloween Parade & Expo or any other event (collectively, "Events") may include risks that could be hazardous to me, and may put me at risk of serious injury or illness, including death. I acknowledge that these risks and dangers may arise from any number of circumstances, including those caused by terrain, weather conditions, equipment, facilities, vehicular traffic, other participants and volunteers in the Events, failures to follow safety procedures, diagnosed or undiagnosed health conditions, and actions of other people. I acknowledge that volunteering in any of the Events requires physical work and I further acknowledge that I am solely responsible for ensuring that I am physically capable of volunteering in the Events. I hereby expressly and specifically assume the risk of injury or harm in the Events. I further confirm and agree that this Release will apply to all Events in which I participate.
I acknowledge and confirm there is no employee-employer relationship that exists between Vancouver International Halloween Festival Society and I. Am acting as an independent individual and I have read and agree to the Volunteer Code of Conduct and will attend the Volunteer Training and Orientation Session.

WAIVER AND RELEASE:

To the fullest extent permitted by law, I hereby forever release, waive, covenant not to sue, exonerate, discharge and agree to hold harmless the Released Parties from any and all liability, claims, demands, and causes of action whatsoever that I may have against the Released Parties with respect to any injury, illness, death, property damage or other loss that may result, directly or indirectly, from my volunteering in any of the Events. I specifically understand and agree that this Release forever discharges the Released Parties from any liability or claim that I may have against the Released Parties with respect to any injury, illness, death, property damage or other loss that may result from the Events, whether caused by the negligence of the Released Parties or otherwise. I further understand and confirm that the Released Parties do not assume any responsibility or obligation to provide financial or other assistance, including, but not limited to medical, health, or disability insurance, in the event of injury, illness, death, property damage or other loss.

MEDICAL TREATMENT:

If I am unable to consent at the time due to injury or illness, I hereby consent to the administration of first aid and other emergency medical treatment for such injury or illness that occurs during any of my volunteering in the Events. Further, I hereby release and forever discharge the Released Parties from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered as contemplated hereunder.
I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Province of British Columbia and that this Release shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invaliding of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. I further agree that this Release shall bind my assigns, heirs, administrators and executors forever.


I agree that all photographs, video or any images taken by employees, directors, representatives or agents or the Vancouver International Halloween Festival Society are the property of the Vancouver International Halloween Festival Society and may be used without the permission of the photographed person. I understand that photo or video of me will be taken for promotional purposes without compensation. I agree to share my photos and videos of the event without compensation.

All volunteers must be 18 years of age or older. If under 18 years, Parental or Guardian Approval and Supervision is required at all times. Children under 18 years without a parent or guardian will NOT be permitted on any site.

Vancouver International Halloween Festival Society Volunteer Code of Conduct

The Vancouver Halloween Parade & Expo is organized and operated by the Vancouver International Halloween Festival Society, a non-profit organization.

CONFIDENTIAL INFORMATION:
As a volunteer for Vancouver Halloween Parade & Expo and any events organized and hosted by the Vancouver International Halloween Festival Society you may be provided with Confidential Information. As a volunteer before, during and after the event(s) agree to keep the Confidential Information strictly confidential, and will not: (a) use it or take any benefit from it except as required when volunteering; or (b) disclose it to anyone including any organization or company unless the Society provides prior written consent or unless volunteer is required by law to do so. As a volunteer you agree to uphold the Code of Conduct.

As a volunteer, you will become an ambassador for our organization, our sponsors, partners. This responsibility should not be taken lightly. By volunteering, you agree to positively represent us and agree to uphold our values including: 

Responsiveness, support and commitment to our community, Innovation, excellence and continuous improvement, Healthy living, Personal achievement at any level, Collaboration, Sustainability, Inclusiveness.

As a volunteer, you become an ambassador of the Vancouver International Halloween Festival Society and we ask you to respect and adhere to the following code of conduct:

1.0	Attend scheduled training sessions and orientation before the event.

2.0	Communicate effectively with your Zone Leader/Captain or Coordinator.

3.0	Be respectful, inclusive and professional.

4.0	Be courteous and use professional language while communicating.

5.0	Arrive 30 minutes before your shift starts.

6.0	Notify your Zone Leader/Captain or Coordinator in case of illness. 

7.0	All Volunteers must be 18 years of age or older. 

8.0	Volunteers are required to carry 2 pieces of Government issued identification.

9.0	As an ambassador for the Society, volunteers shall engage in friendly, appropriate and professional conduct. Should a problem arise, follow the training provided and escalate the issue to your supervisor. Excuse yourself politely and turn the issue over to the proper Society authority to handle the situation.

10.0	 Wear assigned identification gear and event credentials (as provided).

11.0	 Volunteers shall wear appropriate clothing and shoes.

12.0	 Maintain confidentiality. You may be privy to sensitive information.

13.0	 Refrain from bringing valuables like cameras, ipads to your volunteer stations. Vancouver Halloween Parade & Expo is not responsible or liable for lost or stolen items.

14.0	 Volunteers shall not speak on behalf of Vancouver International Halloween Festival Society with, or provide statements to the media (including print, television, radio and social media networks)

15.0	 Volunteers shall refrain from bringing pets, or unregistered volunteers including toddlers and children, friends or anyone else who is not registered to assigned volunteer stations or areas. As they might interfere with you carrying out your responsibilities. Event security will prohibit them from entering secured areas. 

16.0	 Volunteers shall abstain from smoking or drinking while on duty at your station, zone or event area and or be in possession of, or under the influence of, alcohol or non-prescription drugs during the event.

17.0	 Volunteers shall refrain from soliciting tips or gratuities of any kind.

18.0	 Volunteers are required to attend mandatory training or orientation sessions since you will be required and expected to answer lots of questions during the event. We kindly ask you to read all materials provided and familiarize yourself with the course map and essential sites like the first aid station, water station and information booths.

19.0	 DO NOT wilfully damage property on or around event facilities.

20.0	 Children under the age of 18 years must be accompanied and supervised by their parent or guardian at all times while working together in the same area during the event. Vancouver Halloween Parade & Expo is not responsible for looking after or managing children who are unaccompanied by their parent or guardian. Children without a parent or guardian will not be permitted on any site.

20.1	 School groups with students under the age of 18 must be accompanied and supervised by their school teacher. The teacher must be from the same school as the students.

21.0	 Volunteers are responsible for the cleanliness, appearance and safety of their station and equipment.

22.0	  Volunteers shall be aware of Medical personnel stations and availability along the course during the event.

23.0	 As a volunteer for Vancouver Halloween Parade & Expo and any events organized and hosted by the Vancouver International Halloween Festival Society you may be provided with Confidential Information. As a volunteer before, during and after the event(s) agree to keep the Confidential Information strictly confidential, and will not: (a) use it or take any benefit from it except as required when volunteering; or (b) disclose it to anyone including any organization or company unless the Society provides prior written consent or unless volunteer is required by law to do so. As a volunteer you agree to uphold the Code of Conduct.
